Client D.A. contacted Viner Disability Law in December 2016 as her attempts to retrieve her deceased husband’s past-due disability benefits from the Social Security Administration (SSA) had proved unsuccessful. Even though D.A. had been receiving survivor’s benefits since October 2014, she was struggling financially and very much needed the past-due benefits to which her late husband had been entitled.
After filing a request for hearing and reviewing D.A.’s deceased husband’s exhibit file, Viner Disability Law was able to devise a strategy to demonstrate that the medical evidence of record already contained in the file proved that he had been disabled due to his documented medical impairments just prior to his 2007 Date Last Insured (DLI), which would result in the SSA awarding retroactive benefits from the date of his application through the date of his death. In a March 2017 administrative hearing, Viner Disability Law put forth this well-researched and medically substantiated argument, which resulted in a fully favorable decision by the assigned Administrative Law Judge (ALJ) less than one week after the hearing took place.
